Applies to: Eleat Technologies Inc. (Alberta, Canada) and Eleat Technologies Limited (Hong Kong)
These Terms govern an Eleater’s use of Eleat. By creating an Eleater account or using a signed-in Eleat feature, the Eleater agrees to these Terms. In Hong Kong the contracting company is Eleat Technologies Limited. In Canada it is Eleat Technologies Inc. Mandatory rights under applicable law are not excluded.
Eleat is a behavioural hospitality discovery platform. It helps Eleaters decide where to go and what to eat using restaurant information, Happy Hour, Daily Deals, Last-Minute Specials, Game Day, Feeds, reviews, discovery tools and Zaryna. Eleat does not operate the restaurants listed on the Platform. It is not a delivery service and is not the restaurant’s reservation system.
An Eleater must provide truthful account information and keep contact details reasonably current. Date of birth is collected during signup. The Platform may require verification of the sign-in door used. An Eleater is responsible for protecting account credentials and for activity performed through the account.
Eleat can support sign-in using verified contact routes and a password where the current build allows it. Eleat may invalidate existing sessions after a password change, security event, suspension or ban. Eleat does not currently offer MFA or a per-device session-management screen.
Restaurant information can change. Menus, prices, hours, offers, sports coverage, availability and restaurant conditions are controlled by the restaurant or relevant third party. Eleat does not guarantee that a restaurant, item, offer, table, event or broadcast will still be available when an Eleater arrives. Eleaters should confirm time-sensitive or safety-critical information with the restaurant.
When an Eleater chooses Reserve, Eleat may route the Eleater to the restaurant’s own reservation provider or booking page. Eleat does not control that provider’s inventory or confirmation process. A click on Reserve is not a booking. Returning to Eleat is not proof of a booking. If Eleat asks whether a reservation was made, “Yes” records only the Eleater’s self-reported outcome. The restaurant or reservation provider remains the source of booking confirmation.
Information entered on a provider page is governed by that provider’s own terms and privacy practices. Eleat can record reservation intent, the provider used, return timing and information the Eleater later enters or confirms inside Eleat.
A public review requires a verified dining visit under the current review rule. An Eleater must review only a genuine experience and must not fabricate a visit, impersonate someone else, manipulate ratings, threaten a restaurant or publish unlawful content. Eleat may hold, remove or moderate content to protect platform integrity or comply with law.
Published reviews can show the Eleater’s shown name, Eleater ID, ratings, words and uploaded media. Restaurants may post one public response through the review system where that feature is available. Deleting an Eleater account does not delete the review record because restaurant ratings are intended to preserve historical integrity; the associated profile identity is removed by the deletion function.
The Eleater keeps ownership of original content submitted to Eleat. By uploading review text, photos, videos or other content, the Eleater grants Eleat a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format and distribute that content as needed to operate, promote and improve the Platform and to preserve the integrity of review and restaurant records. This licence does not transfer ownership to Eleat.
Restaurant Feeds, Happy Hour, Daily Deals, Last-Minute Specials and Game Day content are restaurant-supplied or restaurant-controlled. The restaurant is responsible for the accuracy, lawfulness, timing, price, quantity, availability and fulfilment of its content and offers. Eleat may remove or restrict content that appears misleading, unlawful, expired, abusive or inconsistent with Platform rules.
Zaryna can assist with restaurant discovery and other Platform functions. Its output is generated from the information available to it and can be incomplete or wrong. Eleaters should not treat Zaryna as the source of truth for allergies, medical issues, legal rights, restaurant availability, food safety or confirmed reservations. Safety-critical dietary information should be confirmed directly with the restaurant.
An Eleater can provide location information to improve nearby discovery. Search and Zaryna requests can use coordinates in the request to narrow results. The current implementation does not store those request coordinates against the Eleater through those flows. The Eleater can deny device location access, but nearby discovery may be less useful.
Do not break the law or encourage illegal activity.
Do not harass, threaten, discriminate against or impersonate another person.
Do not create fake visits, fake reviews or manipulated ratings.
Do not upload malware, exploit code or content designed to interfere with Eleat.
Do not scrape, crawl, reverse engineer or systematically extract Platform data except where law expressly permits it.
Do not try to bypass account, suspension, moderation or security controls.
Do not use another person’s contact information in a reservation or Guest record without a legitimate reason to provide it.
Do not upload content that infringes copyright, privacy, personality, trademark or other rights.
Eleat may restrict or suspend an account for rule violations, abuse, fraud, security concerns or legal reasons. The suspension system supports reasons, time limits, appeals and human or permitted Zaryna-issued decisions. Zaryna cannot issue a permanent suspension under the current database rules. Permanent bans and account deactivation are separate from account deletion.
An Eleater may permanently delete an Eleater account using the deletion function when available in the product. Deletion clears the fields and tables described in the Privacy Policy but does not erase every historical record. Reviews are deliberately retained in de-identified form relative to the deleted profile. Some reservations, visits, analytics and other records currently survive deletion. The Privacy Policy explains the current implementation in detail.
Eleat and its licensors own the Platform software, branding, designs, database structures, interfaces, original text, analytics systems and other Eleat intellectual property. These Terms give the Eleater a limited, personal, revocable, non-transferable right to use the Platform for its intended purpose. They do not transfer ownership of Eleat technology or restaurant-owned content.
Eleat can connect or route to third-party reservation providers, AI services, geocoding providers, payment processors for Restaurateurs and other services. Third parties operate under their own terms. Eleat is not responsible for a third party’s outage, refusal, cancellation, inventory, content or separate collection of information, except to the extent the law makes Eleat responsible.
A restaurant is responsible for its premises, food and beverage, staff, service, allergens, licences, alcohol compliance, safety, pricing, taxes, gratuities, reservations and Guest experience. Eleat does not warrant a restaurant’s performance or the accuracy of every restaurant-supplied claim.
Eleat is pre-launch and evolving. Features may be added, removed, corrected or temporarily unavailable. A screen or database field that exists does not mean a feature is active. Eleat will not describe a not-yet-connected service as available.
To the maximum extent permitted by applicable law, Eleat provides the Platform on an as-available basis and does not promise uninterrupted or error-free operation. Eleat is not liable for losses caused solely by a restaurant, reservation provider or other independent third party outside Eleat’s control. Nothing in these Terms excludes liability that cannot legally be excluded, including mandatory consumer or privacy rights.
To the extent permitted by law, an Eleater is responsible for claims caused by the Eleater’s unlawful content, intentional misuse of the Platform, infringement of third-party rights or material breach of these Terms. This clause does not require an Eleater to indemnify Eleat for Eleat’s own unlawful conduct.
For an Eleater using the Hong Kong market, Eleat Technologies Limited is the contracting Eleat company and Hong Kong law governs these Terms, subject to mandatory rights. For an Eleater using the Canadian market, Eleat Technologies Inc. is the contracting Eleat company and Alberta law and applicable federal Canadian law govern these Terms, subject to mandatory rights. The parties submit disputes to the courts that have jurisdiction under applicable law unless a mandatory rule requires another forum.
Eleat may update these Terms as the Platform changes. A material change should be presented or communicated in a way reasonably appropriate to the change. Continued use after the effective date of revised Terms constitutes acceptance where the law permits that method of acceptance.
